Terms of service

These terms govern use of the Shopclass platform and the shopclasshq.com website, both operated by Ovitas, Inc. ("Ovitas", "we", "us"), 131 Hartwell Avenue, Suite 210, Lexington, Massachusetts. Text-message programme terms are in the messaging terms section below.
The agreement
Shopclass is licensed to schools under a written subscription agreement. Where that agreement and these terms differ, the signed agreement governs. These terms apply to everyone who uses the platform — school staff, instructors, students, and employer sponsors — and to visitors to this website.
Accounts
Schools provision accounts for their staff and students. You are responsible for keeping your credentials confidential and for activity under your account. Tell your school administrator promptly if you believe an account has been compromised.
Acceptable use
- Do not use Shopclass unlawfully, or to store unlawful content.
- Do not attempt to access another school's data, another user's account, or any part of the system you have not been granted access to.
- Do not probe, scan, or attempt to defeat the platform's security, or interfere with its normal operation.
- Do not resell or redistribute the service without our written agreement.
School data
A school owns the records it enters. Ovitas processes them on the school's instructions, as described in our privacy policy. Schools can export their data at any time and can request deletion when their agreement ends.
Fees
Subscription fees, billing frequency, and payment terms are set out in each school's agreement. Fees charged by a school to its own students — tuition, materials, payment plans — are a matter between the school and the student; Ovitas provides the billing tooling but is not a party to those charges.
Availability and support
We aim to keep Shopclass available continuously, but we do not guarantee uninterrupted service. Planned maintenance is scheduled to minimise disruption. Support is provided as described in the school's agreement.
Disclaimers and liability
Except as expressly stated in a signed agreement, Shopclass is provided "as is" without warranties of any kind, to the fullest extent permitted by law. Ovitas is not liable for indirect, incidental, or consequential damages, or for loss of profits or data, arising out of use of the platform. Nothing here limits liability that cannot lawfully be limited.
Changes
We may update these terms; the date at the top will change and material changes are communicated to schools directly. Continued use after an update means acceptance.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules.
Messaging terms (SMS)
Shopclass sends text messages on behalf of the school a student is enrolled at. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help.
What the programme sends
Transactional notifications about a student's own enrolment and account: class reminders, schedule changes, invoice and payment-due notices, and payment-plan alerts. The programme sends no marketing or promotional messages.
How students join
A student opts in inside their school's Shopclass student portal, on the Contact preferences page, by entering a mobile number and checking a box that is unchecked by default. Consent is recorded with a timestamp. A phone number on file is never treated as consent by itself, and consent is never imported from a school's previous software. Opting in is not a condition of enrolment or of any purchase.
How students leave
Reply STOP, CANCEL, QUIT, UNSUBSCRIBE, END, OPTOUT, STOPALL or REVOKE to any message, and messages stop. A confirmation is sent, after which no further messages are delivered unless the student rejoins. A student can also clear the SMS preference in their portal. To rejoin, reply START or opt in again in the portal.
Help
Reply HELP to any message for support information, contact your school directly, or email [email protected].
Carriers
Carriers are not liable for delayed or undelivered messages. Delivery depends on the student's carrier and device and cannot be guaranteed.
Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent are not shared with any third party. See the privacy policy for full detail.
